Told the court he did not drink
I received a call from a woman who said she was in a major custody battle. She said her six year-old son was scared when daddy was driving really fast. The boy said daddy kept hitting the “rough road” meaning the rumble strip. The client got an attorney to do an emergency hearing to discuss her former husband's drinking and driving. Her former husband got up and told a judge that he did not drink and she was a vengeful person trying to hurt his reputation. Well the judge bought the subject’s story. The judge not only agreed with her former husband gave him more visitation. The judge told my client “you are privileged individual who is not going to use this court for her own agenda.” Well after hearing what the judge said my team of ladies was very excited to get the case going.
Saturday morning, Day One:
The former husband took the six year old son to the Metro Diner in Rivergate. We had one of our best investigator on the case that morning. Buffy went into the Metro Diner right along with the subject and his son.
Buffy sat down and ordered some food. Buffy got up and started walking around the restaurant eyeballing the subject. Buffy overheard the subject order to mimosas and said keep them coming. Buffy slipped into the bathroom and called me. Buffy said I cannot wait about my camera and videotape him there are too many people here. I told her at least get one photo of the mimosas on the table. Buffy was able to capture a short video of the subject drinking that mimosa. When the subject was finished paying his tab, he got up and took his son to the restroom. It was at this time that Buffy walked over and take a video of the receipt on the table. However, on the receipt the charge just said two for one. So Buffy turned on her video camera after taking a quick video of the table she continued recording and walked over to the manager. Buffy asked the manager what does it mean on the receipt when it says two for one? The manager said oh that's our mimosas which are two for one on the weekend. Are subject head for Moses before driving away from the restaurant with the child in the vehicle.
Saturday afternoon, Day One:
We put two different investigators at the subjects house after he returned from breakfast. Even though it was a beautiful day, the subject and his son stayed in the house until 2 PM. At 2 PM subject and his son left the driveway and headed downtown Nashville. Around 2:35 PM the subject and his son arrived at a high-end restaurant. The two investigators were very fortunate to have been seated near the subject and his son. In just a few minutes the subject and his son were joined by a female. The female kissed the subject then sat very close to him during the encounter. The subject ordered a beer. The female ordered a Long Island tea. The six year old boy was the only one who ordered any food. The subject ended up drinking two beers in one gin and tonic. The female seemed intoxicated, she was very giggly. One of the investigators overheard the subject suggest that they all go to the Marina where his buddy was relaxing on his boat. After a little over an hour in the restaurant, the subject loaded up his son and headed out towards the marina. The female followed along with her vehicle. At this point the investigators let me know that they had been seen and we needed to switch investigators. We immediately sent two more investigators to the Marina. The two investigators that were already on the case kept eyes on the subject to never went to a boat. The little boy played with some other children near the edge of the water feeding the ducks. Are subject and his girlfriend stayed inside the bar at the marina sipping cocktails. We were not able to hear what he ordered because we were not inside when he started drinking. We were able to document the subject consuming three cocktails before leaving the marina. At 8 PM the subject gathered up his son and stumbled to his vehicle. Our dashboard cams recorded the subject leaving his lane 17 times before he made it home. One thing we noticed as he cannot maintain his speed. He was driving along at 55 miles an hour on Briley Parkway when he left the road completely crossing the rumble strip. After that, he slowed to 40 miles an hour for about two miles. Then he was observed at 75 miles an hour, he left the road, dropped his speed back to 50 miles an hour. We had all we needed for this day so we called off the surveillance at this point.
We continued to surveil this man to document his drinking problem. We followed him for 6 months because the client wanted there to be no doubt in the judge’s mind that her former husband was a drinker.
On one day of surveillance we followed this subject to a major horse race. We had five investigators in the parking lot waiting for him to arrive. We had him surrounded while he stood inside the huge spectator crowd. We observed him purchase 30 drinks between 8 AM and 8 PM. These were blue and white cocktails, his female friend was with him and she was able to keep up with him drink for drink. The child was not with the subject on this occasion. It was a very long drive home and the subject drove his truck at 80 and 90 mph all the way home. I did call the highway patrol and let them know the description of the vehicle but they were not able to pull him over.
Fast forward to the day of court. While the subject was on the witness stand, he told our client’s attorney that he was tired of answering this question and he did not drink. Our clients attorney had photographs of the subject drinking enlarged 11 x 18 so the court could easily see the drinking.
The attorney said so you say haven't had a drink in the last 90 days? Well sir I would like to show you some photographs. The attorney turn around and picked up a large stack of huge photographs. The attorney said sir is this you at the Metro diner? The subject said yes. The attorney said is this a mimosa glass on your table? The subject said that's not my table. The attorney said is this a picture of you at the Corner bar yesterday? The subject said yes that's me but I was not drinking. He said I was only drinking soda water. So the attorney said is this a picture of your receipt from the Corner bar? The subject said yes it is. The attorney said are you telling me that they charge for soda water? The subject said yes they charge for soda water. (By the way we went to the bar the next day in order to soda water and we were not charged.) The attorney ended up showing picture after picture. The attorney had a photo for every day for the last 90 days showing the subject in a bar. Some of the photos had pictures of beers while other photos had pictures of cocktails. The judge was very upset. The judge cut his visitation back to every other weekend. The judge told him if they get one more picture of you drinking while you're in the presence of this child you will be held in contempt of court. This was a huge win for our client.
A week later I got served with a subpoena to come to court because the subject was trying to get a restraining order against me. So I went to court and listened as the subject told this judge that I was stalking him. He told the judge that I was causing him great emotional distress with my constant surveillance. The judge listened to his complaint and it's entirety. The judge let him empty out all of his emotions and she never interrupted him. When he had nothing else to say he looked at the judge hoping she would grant his restraining order. I told the judge that everything he said was the truth. We have been following him everyday. The judge told him she was very sorry that he had distress in his life however she was not going to grant his restraining order. The judge explain to him that it is completely legal for private investigators to conduct surveillance. The judge told him that apparently your ex-wife is willing to spend the money so when you leave this court room today you need to know that private investigators could be watching you at any time. Then the judge looked at me, she said you go ahead and leave my court room. The judge said she wanted me to go directly to my vehicle and leave the parking lot while she finished up with the subject.
